Magna Carta Libertatum or the Great Charter of the Liberties is a historical document of great significance for the constitutional history and human rights and liberties development. Although at its initial version it addressed a limited number of liberties and principles, it represented a solid foundation for the evolution of the principles of the rule of law, right to justice, right to a fair trial, just and reasonable sentencing, limitation of powers, etc. Namely, article 20 of the Charter states: A (...) freeman shall not be amerced for a slight offense, except in accordance with the degree of the offense; and for a grave offense he shall be amerced in accordance with the gravity of the offense, yet saving always his “contenement”; and a merchant in the same way, saving his “merchandise”; and a villein shall be amerced in the same way, saving his “wainage” if they have fallen into our mercy: and none of the aforesaid amercements shall be imposed except by the oath of honest men of the neighborhood. An analysis of this article undoubtedly leads us to the basic principles of the contemporary systems of fine, namely the daily-fine system introduced in the Macedonian Criminal Code in 2004 according to which the fine will be calculated and pronounced according to the gravity of the offence and the financial state and condition of the perpetrator. As one can notice, the gravity of the offence and the saving of the perpetrators “contenement” from the abovementioned article of the Great Charter refer to the aforesaid principles. In this article, a comparison will be made on the meaning of the term “amercement” and its similarities and differences with the modern financial penalties and measures in the criminal law from comparative perspective, to find which one corresponds to the latter: fine, assets forfeiture or compensation of damages made with the criminal offence. In synesthesia, a certain stimulus (eg grapheme) is associated automatically and consistently with a stable perceptual-like experience (eg color). These associations are acquired in early childhood and remain robust throughout the lifetime. Synesthetic associations can transfer to novel inducers in adulthood as one learns a second language that uses another writing system. However, it is not known how long this transfer takes. We found that grapheme-color associations can transfer to novel graphemes after only a 10-minute writing exercise. Most subjects experienced (...) synesthetic associations immediately after learning a new Glagolitic grapheme. Using a Stroop task, we provide objective evidence for the creation of novel associations between the newly learned graphemes and synesthetic colors. Also, these associations generalized to graphemes handwritten by another person. The fast learning process and the generalization suggest that synesthesia begins at the semantic level of representation with the activation of a certain concept (the inducer), which then, uniquely for the synesthetes, activates representations at the perceptual level (the concurrent). Thus, the results imply that synesthesia is a much more flexible and plastic phenomenon than has been believed until now. (shrink)

Figurativity has attracted scholars' attention for thousands of years and yet there are still open questions concerning its nature. Figurativity and Human Ecology endorses a view of figurativity as ubiquitous in human reasoning and language, and as a key example of how a human organism and its perceived or imagined environment co-function as a system. The volume sees figurativity not only as embedded in an environment but also as a way of acting within that environment. It places figurativity within an (...) ecological context, and approaches it as a phenomenon which cuts across bodily, psychological, linguistic, social, cultural and natural environments. Figurativity and Human Ecology will appeal to those interested in the analysis of the all-encompassing creativity of the human mind and in the methodological difficulties associated with the study of cognition. The aim of the paper is to present views and opinions of the representatives of Lvov-Warsaw School upon subject, tasks, methods of aesthetics and its place among others sciences. Although writings on aesthetical problems appeared in the Lvov-Warsaw School relatively late, many scholars from that scientific circle contributed very much to the development of aesthetics - among others - Stanisław Ossowski, Mieczysław Wallis, Leopold Blaustein, Władysław Tatarkiewicz, Tadeusz Czeżowski, Stefan Baley, Władysław Witwicki and Tadeusz Witwicki. The opinions of these philosophers (...) and psychologists (and also other representatives of Lvov-Warsaw School which were not interested in particular aesthetical problems) upon subject of aesthetics and its place among sciences are varied, but they agree that aesthetics is a philosophical science and that the concepts and thesis of aesthetics should be clear and well constructed, whereas incorrectly posted problems - eliminated. The paper provides an analysis of the impact of negative emotions on decision-making processes. It questions the common-sense view that negative emotions diminish rationality of decisions, i.e., increase the probability of making suboptimal choices. It is argued in the paper that this view is untenable on the grounds of neuroscience, cognitive science and evolutionary theory: the results provided by these sciences support the view that negative emotions in most instances of their occurrence, i.e. types of negative emotions, not only fail (...) to undermine rationality of decision-making but substantially contribute to it. This does mean saying that token-negative emotions never undermine rationality of decision-making. But, as is argued in the paper, the fact that token-negative emotions may have sometimes this kind of negative effect is fully consistent with the claim that, as a rule, the effect is positive, so that one can speak about the causal connection between types of negative emotion and rational decision-making. We concentrate on ontological problems – what is aesthetical value and (...) what is the ontological category of valuable object. Tatarkiewicz claims, that: “The term ‘value’ refers to an abstract: property of thing, or to a concrete: to thing endowed with this property”. Many types of aesthetic value (aesthetic value in narrow sense, literary value and poetical value) exist. The only difference between using concept of aesthetic value only in positive sense and using concept of aesthetic value both – in positive and negative sense – is formal. Concerning thesis (1) we claim, that expression “thing” in Tatarkiewicz’s theory is the synonym for “physical object”; not only material objects, but also physical events and processes are Tatarkiewicz’s things as well. In our opinion the concept of aesthetic value proposed by Tatarkiewicz is objective, therefore formulation of thesis of aesthetic subjectivity, which Tatarkiewicz also did, is problematical. Using Tatarkiewicz’s terminology, we construct concept of value as a state of affairs (that some object is endowed with value-property) and we accept monocathegoriality of values (value is a property, a thing endowed with this property or a state of affairs). Concerning thesis (2) we divide all objects into semantic and asemantic and we claim, that in Tatarkiewicz’s theory, only asemantic objects or semantic but semantically uninterpreted object could be endowed with aesthetic value in narrow sense. The aesthetic value in narrow sense is its property considering its appearance or structure. As to the literary and poetical values – they are ascribed to semantic object in consideration of represented object. Concerning thesis (3) we argue, that it is significant whether we use concept of value only in positive sense or both – in positive and negative sense. Only in language with both expressions (“positive aesthetic value” and “negative aesthetic value”) we can formulate the theses about aesthetically neutral objects. (shrink)

U ovom radu istražujem kako su se Hjumova gledišta o odnosu između skepticizma i filozofije razvijala i kako su sazrevala tokom njegovog filozofskog rada. Hjumovo prvo delo, Rasprava o ljudskoj prirodi, ostavlja otvoreno pitanje zašto bi se iko bavio filozofijom u svetlu otkrića da su skeptički argumenti neoborivi. Cilj mi je da pokažem da, iako se Hjumov stav o skepticizmu i njegova skeptička pozicija nisu suštinski menjali tokom godina, Istraživanje o ljudskom razumu i Dijalozi o prirodnoj religiji, kao i nekoliko (...) njegovih kraćih spisa sadrže interesantne promene, dodatke i poboljšanja kada je reč o njegovom shvatanju toga na koji način skepticizam može da utiče na filozofiju. Tek u svom poslednjem delu Hjum nedvosmisleno tvrdi da skepticizam ostvaruje trajan i pozitivan uticaj na naše bavljenje filozofijom, a ovaj uticaj se pre svega ogleda u intelektualnoj skromnosti i ograničavanju predmeta filozofskog istraživanja. The main aim of the paper is to define trade mark and to indicate varied semiotic functions which it fulfils. We define trade mark as a product of man used on the market to identify products or services of a certain firm or to distinguish products or services of a certain firm from those of other firms. All trade marks fulfil an identificative or differentional function. We distinguish trade mark from trade name: the trade name becomes a trade mark iff (...) it has such-and-such a specified visual form. We claim that trade name is a proper name which refers to a certain firm and has no connotation. Trade mark in advertising (1) refers to particular products or services and (2) connotates the product’s (service’s) property being produced or distributed by a particular firm. The trade mark placed on the package of some product is both: (1) an index sign, which “points to” the fact that the object in the package is produced or distributed by such-and-such a firm and (2) a performative (a sign which generates a new state of affairs), which certifies that the object in the package is produced or distributed by such-and-such a firm. Predmet ovog rada je istraživanje i kritika nekih aspekata teorije Dejvida Luisa o tvrđenjima kojima se pripisuje znanje subjektu. U prvom odeljku izlažem skeptički paradoks i osnovne postavke epistemičkog kontekstualizma. U drugom odeljku objašnjavam na koji način Luis kombinuje teoriju relevantnih alternativa i epistemički kontekstualizam prlikom formulisanja svoje teorije o tvrđenjima kojima se pripisuje znanje subjektu. U trećem odeljku pokazujem da ova teorija dopušta postojanje znanja koje je zasnovano samo na ignorisanju i argumentujem da ova nepovoljna posledica proističe iz načina (...) na koji Luis formuliše pravilo verovanja u okviru svoje teorije. U zaključnom odeljku ukazujem na problematične aspekte i ad hoc karakter Luisovog pravila pažnje i tvrdim da je ono tako formulisano da bi omogućilo rešavanje skeptičkog paradoksa. Zaključujem da je Luisova teorija o tvrđenjima kojima se pripisuje znanje subjektu neodrživa u svom originalnom obliku. (shrink)

Predmet ovog rada je Vitgenštajnovo razlikovanje i novo razumevanje pojmova znanja i izvesnosti u spisu O izvesnosti iz kojih proističe i njegova inovativna kritika skepticizma. On pokazuje da čitava rasprava o skepticizmu nastaje zato što i tradicionalni epistemolozi poput Mura i skeptik pogrešno shvataju prirodu takozvanih murovskih iskaza koji predstavljaju sadržaj naših osnovnih verovanja kao i naš stav prema njima. Vitgenštajn tvrdi da ovi iskazi nisu ni istiniti ni lažni već da funkcionišu poput pravila te da stoga ne mogu biti (...) ni predmet znanja niti podložni sumnji. Naš stav prema njima nije epistemički već je odraz praktične sposobnosti učešća u jezičkoj praksi. Vitgenštajnov najubedljiviji i najoriginalniji argument protiv skepticizma pokazuje da skeptik, formulišući svoje sumnje, dovodi u pitanje sopstveno razumevanje reči kojima se pritom služi. Na kraju se tvrdi da sam Vitgenštajn zastupa jednu vrstu naturalizma hjumovskog tipa. (shrink)

The author characterize Paul Horwich's view on truth formulated in his deflationary theory of truth. She presents selected problems which arise when one analyze the elements of the theory in a more detailed way. She investigates the mentioned problems in order to show the importance of such categories like truth, acceptance, understanding, proposition and property for philosophy of language. The author concludes with a claim that philosophical acceptance (or antipathy) for minimalism in theory of truth is connected with some metaphysical (...) assumptions which are taken for granted in advance. Vježbanje u kršćanstvu posljednje je Kierkegaardovo veliko djelo. Nastalo je kao kompilacija više članaka, a konačno je objavljeno 1849. godine. Njime je Kierkegaard zaokružio svoje tumačenje kršćanske religije. Pitanja kojima možemo sažeti ključne teme kojima se za života bavio su sljedeća: kako postati kršćanin, koje su glavne teze kršćanske doktrine, može li se dokazati Božje postojanje , u kakvom su odnosu vjera i razum, jesu li religiozna vjerovanja racionalno utemeljena i dr. U ovom radu iznijet ćemo Kierkegaardova pojašnjenja kršćanske religije, (...) uspoređujući ih s tezama koje je izložio u ostalim djelima . U tom smislu Vježbanje u kršćanstvu poslužit će nam kao potvrda njegovih ranijih razmišljanja i stavova o kršćanskoj religiji.Practice in Christianity is the last Kierkegaard’s great work. It is made as a collection of several essays and was finally published in 1849. With this book the Danish philosopher completed his interpretation of Christianity. Questions that occupied him during his life were: how to become a Christian, which are the main theses of Christian teaching, can God’s existence be proven , what is the relation between faith and reason, are religious beliefs rationally established, and the like. In this paper we will summarize Kierkegaard’s account of Christian religion comparing it with the theses that he espoused in his other works . In this sense Practice in Christianity will serve as a confirmation of his earlier thoughts and attitudes about Christian religion. (shrink)

The Unconscious Religiousness in Victor Frankl’s Logotherapy Project In his logotherapic vision of life, Frankl appeal to the concept of an unconscious God. I consider, Polish translation, The Hidden God in this case, irrelevant. The term ‘unconscious’ is being used in his writing not by mere coincidence. It touches the sacral sphere of life. Similarly to Jaspers, faith doesn’t have dogmatic characteristics. It is connected to a conscious will of a human being. Authenticity is a characteristic of the true religiousness. (...)
